In today’s hearing in Baton Rouge, District Judge Janice Clark agreed that the Animal Legal Defense Fund and two Louisiana residents can be parties to the lawsuit filed by Michael Sandlin, owner of Grosse Tete’s Tiger Truck Stop, against the Louisiana Department of Wildlife and Fisheries (LDWF). ALDF and the other interveners seek to defend the state’s law banning private ownership of big cats. Thanks to today’s ruling, ALDF will now have a right to participate in all steps of the litigation as it moves forward.

In their case, Sandlin and the Tiger Truck Stop are suing the state, arguing that Louisiana’s ban on private ownership of big cats like Tony is unconstitutional–flying in the face of the current national sentiment that dangerous exotic animals should be more strictly regulated. Ohio is currently considering a bill that would ban new ownership of captive wild animals, following the massacre of 48 animals including lions, tigers, and bears, who were released by their Zanesville owner last October. Additionally, in February, a bipartisan bill–the “Big Cats and Public Safety Protection Act”–was introduced in the U.S. House of Representatives that would prohibit the breeding and private possession of captive big cats. ALDF’s intervention in Sandlin’s case will support Louisiana’s power to safeguard public safety and the welfare of animals like Tony through such legislative measures.

In today’s hearing in Baton Rouge, the judge ruled ALDF’s plaintiffs lacked standing in our lawsuit to force the Louisiana Department of Wildlife and Fisheries to do its job of enforcing Louisiana’s big cat ban now that the Tiger Truck Stop and Michael Sandlin are keeping Tony the tiger without a permit, in open violation of state law. The judge also ruled that department has discretion whether or not to enforce Louisiana’s law banning private ownership of big cats at this time.

Over 50,000 of Tony’s supporter have signed an ALDF petition to the Louisiana Department of Wildlife and Fisheries over the past year, urging them to do their job–we’re all getting tired of waiting for the department to do the job it’s supposed to do and protect the best interests of both Tony and the public.

Today’s decision in no way affects the judge’s ruling that Michael Sandlin and the Tiger Truck Stop cannot be granted a permit to keep Tony. We fully expect that once all the legal proceedings relating to this case have wrapped up, the Department will do the job it is supposed to do and make sure Tony is no longer displayed without a permit. We are considering our options for appeal in today’s decision, and we are continuing to fight Michael Sandlin’s attempts to delay the inevitable day when Tony will finally go to a suitable forever home at a sanctuary where he can live out his days as a tiger should.

“The eyes of a disbelieving nation have been on this case for well over a year, says ALDF Executive Director Stephen Wells. “We’re all wondering the same thing: why should Tony continue to languish at the Tiger Truck Stop, so many months after the judge’s ruling in our favor?”

Two hearings are scheduled for the coming week in the ongoing case of Tony, the eleven-year-old Siberian-Bengal tiger kept at Grosse Tete’s Tiger Truck Stop.

On Thursday, May 3, the court will consider the Animal Legal Defense Fund’s most recent lawsuit against the Louisiana Departnent of Wildlife and Fisheries (LDWF). The lawsuit, filed on April 5, seeks to force LDWF to do its job of enforcing Louisiana’s big cat ban now that the Tiger Truck Stop and Michael Sandlin are keeping Tony without a permit, in open violation of state law.

On Monday, May 7, the court will hear ALDF’s petition to intervene in the lawsuit filed by the Tiger Truck Stop and its owner Michael Sandlin against the state of Louisiana. Their case argues that Louisiana’s ban on private ownership of big cats like Tony is unconstitutional–flying in the face of the current national sentiment that dangerous exotic animals should be more strictly regulated. ALDF’s petition in intervention supports Louisiana’s power to safeguard public safety and animal welfare through such legislative measures. An ALDF representative will be testifying at the hearing.

Baton Rouge, La. – This morning, the Animal Legal Defense Fund (ALDF) filed a lawsuit to force the Department of Wildlife and Fisheries to do its job of enforcing Louisiana’s big cat ban in the case of Tony, Grosse Tete’s “truck stop tiger.” Michael Sandlin’s permit to keep Tony, an eleven-year-old Siberian-Bengal tiger, expired in December, yet he has continued to keep Tony confined at the Tiger Truck Stop, in open violation of state law. ALDF’s lawsuit would compel the Department to take steps to enforce the law and report Sandlin’s illegal possession of Tony to local law enforcement for prosecution. In addition, ALDF, along with two Louisiana residents, today filed a petition to intervene in Sandlin’s current lawsuit against the state; the interveners seek to defend the state’s law banning private ownership of big cats. The law offices of Baker, Donelson, Bearman, Caldwell, & Berkowitz, P.C. are providing pro bono assistance with the lawsuit and the petition to intervene.

In November 2011, the East Baton Rouge District Court granted ALDF’s request for a permanent injunction against the Louisiana Department of Wildlife and Fisheries, ordering the Department to revoke the permit that allowed Sandlin to display Tony as a roadside exhibit at the truck stop where he has languished for over a decade. Despite the fact that Sandlin’s permit expired in December and cannot be renewed, he continues to display Tony, in violation of the big cat law, which the Department is responsible for enforcing.

“The state of Louisiana has explicit regulations designed to protect tigers like Tony, and the Department of Wildlife and Fisheries is required to enforce them” says ALDF Executive Director Stephen Wells. “The court has already granted Tony and ALDF a victory by ruling that Michael Sandlin’s permit to display Tony was illegal. Sandlin, now without a permit, cannot be allowed to continue to exploit this tiger with impunity.”

    Fish & Wildlife is more concerned with selling fishing licenses than protecting the well being of an animal that has been confined and tortured for so many years.
    And now they are “exhibiting” him without a license!!
    Put them out of business and turn the tiger over to a sanctuary for the remainder of his life!
    Get with it Fish and Wildlife-or the only wildlife that will be left will be people!!!

    Since when has it been constitutional to own a tiger privately? Last i looked the Constitution left a lot up to the states to consider and a lot of states openly demand either a permit or some kind of method to ensure a wild animal is kept safe. Other states outright ban the ownership of exotic animals. Besides doesn’t anyone remember what happens when you know that exotic animal escapes and the competes with native animals for you know food and territory. You know like the Florida Everglades and the pythons….just putting it out there.

    This is ridiculous, this poor tiger has been locked up in this HORRIBLE cage long enough. This is TORTURE to let an animal suffer like this. And it is all because of GREED. The judge needs to put a STOP to this, he SHOULD take Tony away from this man and place him somewhere safe. Wild animals SHOULD be in the wild, NOT in cages and zoos OR by the roadside for profit. Tony needs to be with other tigers and be able to roam in open spaces. This is VERY wrong to confine an animal like this, all of there lives. This is CRUEL, ABUSIVE AND INHUMANE TREATMENT. PLEASE get Tony out of this HORRIBLE cage and to a new and safe environment. Just think how you would feel if you where locked up ALL the time, in the heat and cold and NOT being cared for properly. PLEASE do the humane thing and give Tony his life back. He has SUFFERED ENOUGH.

    Shame on the owners and the people who are suppose to enforce the law. Also if I were govenor I may just consider giving these morons their pink slips(You know…the old trying to reduce the budget theory) and possible replace those jobs with people who will do what they are suppose to do when they are suppose to do it.

I fear it SHOULD be a cautionary statement, however, because I understand — I can’t believe this is actually the case, but it seems it is — MICHAEL SANDLIN will have the right to determine where Tony goes. That’s like asking a hoarder or a puppymill operator who should get the tortured animals whove just been rescued from their clutches!     I have been following Tony the Truck Stop Tiger’s plight for several years now. It is simply egregious that Tony is still being held a prisoner by the abusive Mr. Sandlin. Since when are people allowed to just disregard the law if they don’t like it and do what they want with no penalty? Tony should have been removed from Mr. Sandlin’s possession immediately upon the Louisiana court’s ruling that his possession was unlawful. There are so many accredited sanctuaries in this country that would gladly take Tony into their care. Mr. Sandlin’s illegal possession should not be fostered further by allowing him to pick where Tony is sent. That is like sending out a fox to guard the hen house. Mr. Sandlin’s possession of Tony has been unacceptable for 11 years now. As we move into the summer months, when the heat and humidity in Louisiana are abominable, isn’t it about time that some Louisiana state agency does the right thing for Tony and moves him to an accredited sanctuary? The continued abuse of Tony by Mr. Sandlin and the state of Louisiana is totally unacceptable and must be stopped immediately.

This tiger belongs in a nice animal sanctuary where he can enjoy the rest of his life in peace away from people who tease him at the truck stop. Besides, he should not have to be cooped up in a cage, smelling car and truck fumes all day long.     They clearly are not enforcing Louisiana’s big cat ban in the case of Tony, Grosse Tete’s truck stop tiger.
    This is inhumane, appalling, and inexcusable.
    At the very least, an Order to Show Cause must be issued to have DWF come to court show cause why it is not enforcing its own law.

    Where does everyone think this tiger should go? Most sanctuary’s do not provide as much room for an encloser as this tiger has its my understanding that his encloser is about 3000sq ft. Please if any questions about the size most sanctuaries have do a google search for different ones. I can think of one in florida that does not provide that much room and the enclosers are not as well maintained and all the animals can do is pace, this animal shoulf be allowed to live out its life where it is and has been raised if there is no neglect/abuse. ALDF you need to go after the sanctuaries that dont provide proper care/diet/enrichments. 2here were you when you were needed in Texas?

    Good grief is this saga still going on? At this rate Tony will die of old age before he is removed. If the Judge has decided in ALDF’s favour, why on earth has Tony not been removed and placed in a sanctuary. All animals need to be with their own kind and to have him languishing at a truck stop, alone, purely for spectacle purposes is mental cruelty, if not actual physical cruelty, and I would not be too sure about possible physical cruelty either. For heaven’s sake, show some fortitude and remove him as the law is on your side – as is the public.

    I appreciate all the work on Tony’s behalf by the ALDF and the many thousands of people that have written letters and emails on Tony’s behalf. We WILL all continue to make our voices heard since Tony cannot speak for himself.

    For those that have never actually been to the Tiger Truck Stop where Tony is held for his 11th year, please go see it for yourself. You cannot seriously believe this small, filthy, inadequate space is appropriate for the best health and welfare of Tony! He needs the ability to interact with other big cats, if at all possible, and enjoy the benefit of stimulating things to explore and appropriate veterinary oversight for his healthcare. A certified big cat sanctuary can and will provide this and more for Tony if the Louisiana Department of Fisheries and Wildlife will enforce the laws of the state.

    Mr. Sandlin wants Tony strictly for HIS financial gain. If he truly loved and cared for Tony, he would want him to have an enriched life with other big cats in an appropriate facility, away from the stench of gas, oil, and diesel fumes, not to mention living in the stench of his own waste as it is simply hosed off the cement Tony lives on.

    Please keep up the fight to give Tony a better life than he has had to endure these past 11 years!

    I don’t understand WHY this Judge refuses to acknowledge contempt of court in his/ her our court ruling! It is plain as day for us to see, these people are defying a court order! In other words they are walking out of the court room is coming there nose at the judge’s decision, and the judge is not upholding their ruling. Makes you wonder if they’re buddies with the fish & game department! This just needs to step up and see that the evidence is there to support those who want to free Tony & and get him out of this truck stop, immediately! (Notice, I didn’t capitalize either the words court or judge because neither deserve it) As Americans in a free country, those of us who deserve the title of human beings teach our children to respect and care for all life. Especially animals who depend on us for their wonderful existence. This issue is so non-disputable; hold a wild animal captive which IS abuse, and you’re automatically guilty. This is wrong on so many levels, it’s insane. The fact that it’s still an ongoing issue is reprehensible.

    I totally agree with 60. Someone should just take him to let him free.I’m sure there’s enough legal stands to confiscate him and put him in a decent place.

    Please try to get Tony out of that horrible situation. Yes, we have been signing petitions and battling this cause for months and months, and months. Tony was supposed to have been moved last December latest, but he’s still there.

    Do we want Tony to be poisoned, alone and deprived of some good sort of life in a cage as a tourist attraction? No, we want Tony out of there and safe to live the rest of his life in peace.

    Please everybody – picket the place if you’re need – do whatever you can to free Tony – the owner of the station is inhumane and a ‘mad man’!

    Thank you for all your hard work for Tony. I was waiting for the good news in December that he had been released and never saw anything. This is very upsetting and am hoping there will be a resolution soon and Tony can live the remainder of his life in freedom.

  69. What alternate reality is this judge living in stating that agencies have discretion over following or not following the law? Tony the Tiger should be removed from that horrible truck stop setting immediately!!! Citizens should help keep the pressure on to force the Louisiana Dept of Fish and Wildlife to honor the law and to stop the cruelty that this animal has been forced to live in for far too long. If the owner actually cared about Tony he would turn him over to a sanctuary. We have all tragically seen the effects of animals traumatized by improper captivity! Keep fighting for Tony and all animals! To that judge I would say your ignorance of enforcing the law is no excuse to torture this big cat further!!!!

    Why doesn’t the owner just let this poor tiger go? Tony’s not getting any younger, and he deserves to be able to live in his natural habitat while his health his still good. The owner’s true character is quite clear when you look at his selfish motivation in wanting to keep Tony!

    People like this will weep what they sow..when judgment day comes, let’s hope he remembers what heartless crimes he has committed against this like animal. I pray that animal.cruelty laws add enforced with harsher penalties..maybe then, we will see less of this type of cruelty.
